Cell Phone Use While Driving Penalized Less in CA Compared to Other States

The California Office of Traffic Safety 2011 Statewide Traffic Safety Survey states that one of the biggest safety problems on California Roadways is talking on the cell phone while driving which accounts for 20.3 % of the problems (up from 15.9 % a year ago) and also Texting on the phone while driving is another big one (making up 18.5 % from 2.4% a year ago).

What’s surprising is that despite cell phone use while driving accounting for a large safety problem, the State of California is more lenient on how they punish drivers for violation of the hands free law as compared to other states.

In Illinois a cell phone ticket can lead to a suspended license, in Nebraska can lead to 3 points being added to your driving record. Compare to California where the first offense does not even result in a point being added to your record and a second offense only results in one point being added to your driving record.

In addition the State of Illinois imposes a fine of up to $1,000 for texting while driving. Utah and Oregon which fine up to $750 and $720.
