California Basic Speed Law Speeding Ticket Dismissed

A popular type of ticket that we help drivers’ fight is the California Basic Speed Law Speeding Tickets. Take this case for example:

Michelle came to staging-vadusuxe.kinsta.cloud earlier this year with a ticket for “unsafe speed” (54 miles-per-hour in a 40 miles-per-hour zone). The law she was cited for says no one can drive “at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway,” or “at a speed which endangers the safety of persons or property”.

We helped Michelle put together all the necessary documents for fighting her ticket and mailed these documents to court for her. Her documents, called a Trial by Written Declaration cited many reasons her ticket should be dismissed, including the total lack of evidence that she drove at an unsafe speed. She had been driving in clear weather, there was not heavy traffic, she was not near a school zone, a construction zone, or even a senior citizen zone. In addition to all these details working in her favor, the officer also had no clear line of sight to her vehicle given vehicles right in between them. Michelle felt the speed the officer cited her for was not accurate.

We recently received notice from Michelle that her ticket was dismissed with no points being added to her record! Even better, the court refunded the bail she had paid amounting to a total of $244.00 refunded by the court.  –  blog submitted by staging-vadusuxe.kinsta.cloud, helping drivers contest and dismiss their traffic tickets.
