What is the Basic Speed Law in California?

“No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”

Overall, the California’s basic speed law says you must drive at a reasonable speed based on:

  • Weather – A California driver is responsible for adjusting their speed depending on current weather conditions. 
  • Visibility – Rain, fog, snow, dust or smoke can make it difficult to see ahead. When you cannot see the road clearly then definitely slow down.
  • Traffic – Go with the flow of traffic. If those around you are slowing down, you should also slow down. 
  • Number of Vehicles – More cars on the road, the higher chance of an accident. Make sure you are aware of what the other cars are doing.
  • Road Surface – If your tires are having traction problems make sure to adjust your speed accordingly. This can happen when the road is wet, icy, or snowy.
  • Width of the Road – May need to drive slower due to narrow roads or winding turns.

Therefore, if poor road conditions then you are expected as a driver to slow down to an acceptable speed.

Can I Get a Basic Speed Law Speeding Ticket?

Yes, you can get a basic speed law speeding ticket. This is vehicle code 22350. Keep in mind, no matter what you cannot drive at a speed that endangers others. Therefore, even if you are driving the speed limit, the police officer may still believe you were going too fast for the present conditions.

Can I Fight an Unsafe Speed Traffic Ticket?

Again, yes! An officer is making judgement call when it comes to whether or not you are traveling at a safe speed. However, If you believe you were going at a reasonable speed then definitely fight this ticket.

A Trial by Written Declaration

A trial by written declaration is a way to fight your traffic ticket through writing instead of in-person trial. This is the easiest and best way to get a traffic ticket dismissed. For the trial by written declaration, you must use the TR-205 court form, and you have to fill up necessary information such as name, citation number and address. Additionally, you must submit the form along with an explanation of what happened and why your ticket should be dismissed. In California, speeding over 100 miles per hour is an infraction however you will likely be required to make a mandatory appearance in court. A driver feeling down on his luck came to staging-vadusuxe.kinsta.cloud with a Los Angeles County speeding ticket. The Los Angeles County Sherriff Department had issued a ticket for 4 miles per hour over the speed limit with use of laser detection. staging-vadusuxe.kinsta.cloud ticket fighting experts got to work gathering the facts and circumstances behind the ticket through an over the phone consultation with the driver. staging-vadusuxe.kinsta.cloud then prepared a Trial by Written Declaration describing the incident, raising the requirements the officer must meet in order to use evidence of laser, and requesting for a dismissal based on several factors including why the officer could not have had a clear line of sight to the driver’s vehicle to accurately assess speed using laser. Laser is said to be more accurate than modes of speed detection such as radar, but the officer still must have a clear line of sight to the target vehicle! In this case, the officer had been parked very far away and any attempt to clock the driver’s car would have been diminished by the driver’s vehicle being surrounded by other vehicles. Terry came to staging-vadusuxe.kinsta.cloud in October of 2012 with a speeding ticket. Terry was stopped by CHP on the I-10 out in Riverside County, and Police had told Terry he was tracked by plane driving at 92 mph, but Terry didn’t agree.

Terry signed up with staging-vadusuxe.kinsta.cloud and completed an over the phone consultation with a staging-vadusuxe.kinsta.cloud consultant. Terry informed staging-vadusuxe.kinsta.cloud that he had been traveling with traffic all around him and felt the officer had mistakenly targeted him. Based on Terry’s account of the traffic, road conditions, and affirmation that he always made frequent checks of his speedometer and had felt his speed was different than what the officer said it was, we felt there was a good chance the officer in the airplane that supposedly spotted Terry’s car speeding, had mistaken Terry’s car for someone else and mistakenly reported Terry’s car to be pulled over by the police officer on the ground.

Based on the information written by the officer on Terry’s ticket, there was only the aircraft used to gather evidence in support of the violation. Florida woman, Melissa Miller, was stopped by police after a high speed chase through a residential area where she was alleged to have been driving at 100 miles per hour as reported by CBS Tampa. When she was finally stopped, police asked her why she did it. Her excuse? God made her do it (as reported by WFTS-TV)! A popular type of ticket that we help drivers’ fight is the California Basic Speed Law Speeding Tickets. Take this case for example:

Michelle came to staging-vadusuxe.kinsta.cloud earlier this year with a ticket for “unsafe speed” (54 miles-per-hour in a 40 miles-per-hour zone). The law she was cited for says no one can drive “at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway,” or “at a speed which endangers the safety of persons or property”.
