California Traffic Law: Two Lane Highways

When driving across the more rural and open areas in California, or even on cross country highways, it’s not uncommon to come across sections of two lane undivided highway. While it can be tempting to gun it down these long open stretches of road, there are some laws specific to these roadways that most people aren’t aware of. 

Speed Limits

While there are posted speed limits on a two lane undivided highway, there are some circumstances where following the speed limit isn’t as cut and dry as not going over the posted speed limit. If there is no posted speed limit, the speed limit on California two lane highways is usually 65mph. Some highways allow up to 75mph, and are posted as such. To be on the safe side, always try to hover between 50-60mph if you’re unsure of the speed limit under normal conditions.

Here’s where things get a little more complicated. If you are towing another vehicle or trailer, your maximum speed can not exceed 55mph regardless of the posted speed limit. If there are severe weather conditions such as heavy fog, snow, torrential downpours, and the like, driving anywhere above 20mph under the posted speed limit could land you a ticket for excessive speed in lieu of the weather conditions. So, if you’re driving 45mph in a 55mph zone in the fog, you could get a ticket.

Other Rules of the Road

As one would expect, all of the normal rules of the road apply when driving on two lane highways. Failing to do so will certainly net you a traffic ticket if you’re caught or get in an accident. There are some miscellaneous traffic laws that many people overlook though. Here are a few to keep in mind.

-If a person is looking to pass you and you are driving in the fast lane (usually the left lane), you are required to move to the right lane when it is safe to do so in order to allow the other person to pass. While you must drive slower in heavy traffic or bad weather, if you are intentionally driving slower than the current flow of traffic, you must use the right lane.

-If you are towing any kind of load, be it another vehicle, trailer, or other type of hitch-able load, you are required to drive in the right lane.

-When near animals, you are required to slow down, or even stop when safe to do so if a stray animal is in the roadway.

Also, since it is a two lane undivided highway, always be aware of your surroundings. There is only one way traffic, so if there is any indication someone may be heading in the wrong direction, use extreme caution, and considering pulling off of the road if possible for your safety. When there is light or no traffic, people sometimes tend to speed, even over the posted limit of 75mph. If you need to change lanes, always ensure your blind spot is clear, and that no one is approaching in the other lane at high speeds. In almost all cases, the person changing lanes is the at fault driver, and it may net you a ticket for failing to yield the right of way, along with a potential insurance payout to the other driver for their damages.

For example, if there is something on the road that needs to be removed, such as a tire tread or debris, the police may use a rolling roadblock to clear the area just around the object so it can be picked up safely.

Another common example is when there is road work being done. Police officers may create a rolling roadblock around the workers to slow down traffic or even re-route drivers for everyone’s safety.

Yet another all-too-common example is when there has been an accident on the roadway. Rather than completely shutting down the freeway, officers may use their vehicles to create a rolling roadblock that re-routes drivers around the area where the accident occurred.

And sometimes rolling roadblocks are simply used to break up severe traffic congestion, especially around major intersections where accidents frequently occur.

How Does a Rolling Roadblock Work?

Here is a basic step-by-step of how most rolling roadblocks are carried out.

First, the officers gather near the area that needs to be cleared. Using their two-way vehicle communication systems, the officers involved coordinate their break strategy.

The officer(s) turn on their flashers and sirens and begin to weave or swerve in and out among traffic. This causes the other drivers to slow down and become watchful. When the danger has passed or the congestion has eased, the rolling roadblock concludes and it is back to business as usual.

How Should You Behave and Drive?

It can be stressful to find yourself suddenly involved in a rolling roadblock. Here is this police vehicle (motorcycle or car or both), sirens wailing and lights flashing, driving erratically for no apparent reason you can detect.Your initial instinct will likely be to either slow down (which is the intent of this police maneuver) or try to speed up and get past it all. 

Whatever you do, you don’t want to speed up and try to drive around the officers! This is one quick way to get yourself pulled over and ticketed. Trying to pass a police vehicle conducting a rolling roadblock is illegal in the state of California and is grounds for an immediate moving violation citation.

Not only will you likely be cited, but you also run the risk of hitting other vehicles (including the police vehicles) or finding yourself in the midst of the accident, road debris, construction or other incident which prompted the initiation of the roadblock in the first place.

The hands-down best way to conduct yourself during a police rolling roadblock is to stay calm, slow down, follow all police instructions and be patient until the rolling roadblock has ended.

Sometimes you may feel tempted to drive around the rolling roadblock by using the open shoulder on either side (left or right). This, too, will get you ticketed faster than you can say “rolling roadblock.” 

Not only is it illegal to use the shoulder of the freeway for driving, but it is also illegal to use the shoulder (or any lane) to pass a police vehicle who is setting up a rolling roadblock.

But there is one more way you may earn yourself a traffic ticket during a rolling roadblock, and it is one that you might not suspect: driving too slow. These tickets can be just as pricey as speeding tickets. Rather, simply follow CHP’s speed lead.

Strategies to Get Your Traffic Ticket Dismissed

Chances are good that the moment you saw that red light camera citation in your mailbox, your mind started racing with ideas for how to get it dismissed. But are there any strategies that actually work?

Demonstrate a clean driving record.

If you have a clean – and here we mean squeaky clean – driving record, you may be able to use this to demonstrate that the red light citation was most likely an error. 

But we don’t recommend trying this tactic if you have any incidents of any kind on your driver record over the last 36 months.

Make your court date to contest the citation and hope the officer doesn’t show.

This approach will only work if the officer who wrote you the citation does not show up. If the officer does show up, it will be your word against theirs and guess whose word the presiding judge is likely to take more seriously?

Ask for a six-month deferral (deferred adjudication).

With this strategy, you can request that the citation be kept off your license for six months, during which time you will be expected to keep your driving record utterly clean. 

The way this can backfire is if you get another citation during that six-month period – for anything at all. If this occurs, you will not only be on the hook to pay the full fine from your red light citation, but you will also have to pay for the other citation. 

Plus, you won’t have the option to take defensive driving to keep either ticket off your record and you will rack up the points.

Go back and check the intersection for a sign.

In the state of California, any red light camera zone must have signage to alert drivers the camera is there. However, the camera doesn’t have to be at the intersection where the camera is placed, just near to it.

If your citation is related to a camera snapshot and you can go back to the site and verify there is no posted signage, you may be able to get your citation dismissed by a judge.

Cite necessity as your reason for running the red light.

In some cases, running a red light may be necessary to ensure your safety and the safety of others. Being able to prove that you ran the red light because that was the safest option may influence the judge to dismiss the citation.

Slick roads, an obstructed view, an officer who was not positioned correctly to see the unfolding events with clarity, another car that was driving erratically – these may all be valid reasons a judge will uphold when dismissing your citation.

When You Should Think Twice About Contesting Your Ticket

If you got a letter in the mail that includes a photograph of you driving through the intersection after the light turned red, or if you got a citation with a link to a video that clearly identifies your car driving through a red light, it may be unwise to try to contest the citation.

Why is this? If the camera or video was programmed to trigger a photo or video recording after the light turns red, it will not be possible to contest your ticket UNLESS there was a safety issue or missing signage you can bring to the judge’s attention.
