Should Courts Charge For Dismissing a Ticket

Most of us have received a fix-it-ticket at one point or another. Whether it be a broken tail light, a missing license plate, or expired registration, the court will generally dismiss a fix- it or correctable ticket upon a showing of proof that the violation was corrected or fixed. The standard fee California Superior Courts charge for dismissing a correctable ticket is $25 and no point is added to a driver’s motor vehicle record.  In other counties across the U.S. a driver might be charged as much as $50 as a fee for dismissing a correctable violation.

As reported by Newsday.com, Lawmakers in Suffolk County, New York are speaking out against what they feel are outrageous fees for dismissal of minor fix- it- tickets. To illustrate the problem, New York Legislator Rob Calarco cited the case of a constituent who recently was issued a ticket for a broken taillight. Under New York state law, such a ticket can be dismissed if the driver proves the light was fixed within 24 hours. The constituent made the fix and the ticket was thrown out, but she still had to pay $50, Calarco said.
