When Contesting A Ticket In Writing Does The Officer Really Have To Respond

When Contesting A Ticket In Writing Does The Officer Really Have To Respond blog submitted by staging-vadusuxe.kinsta.cloud, helping drivers contest and dismiss their traffic tickets.

When you contest a ticket in writing through a Trial by Written Declaration both the driver contesting the ticket and the officer who wrote the ticket have a chance to submit their side of the story to a judge. A common concern for drivers contesting the ticket is whether the officer has to respond and if not can the court find them guilty based on the ticket alone and no explanation from the officer.

Whether the officer responds or not the case is supposed to be submitted for a decision. (2014 California Rules of Court Rule 4.210. Traffic court-trial by written declaration) In addition, the court might consider the ticket/notice to appear evidence of the violation. (California Vehicle Code 40901)

In our experience of helping over 50,000 drivers contest over 80,000 tickets, we rarely if ever hear of someone being found guilty when the officer does not respond. In almost all cases where the officer fails to respond a judge will dismiss the ticket “in the interest of justice” or “due to lack of prosecution.” – blog submitted by staging-vadusuxe.kinsta.cloud, helping drivers contest and dismiss their traffic tickets.
