As reported by WOAI.com News, video kiosks connected to the municipal court put people face-to-face with a judge, allowing everyone to skip the hassle of driving down to the courthouse.  The video kiosk allows you to talk to someone immediately at the court and a clerk will first screen a case then bring in a judge to take a plea. Those who use the kiosk will be able to request probation or a driver’s safety course and pay for the ticket at the kiosk.

Officers are human and can make mistakes just like anyone else. Just because you got a stop sign ticket doesn’t necessarily mean you really broke the law. Here are some tactics to consider when deciding to challenge a stop sign violation ticket:

  • Read the language on the ticket.

Did the officer write that you failed to stop at the limit line or failed to stop at all?

Now, if the officer wrote that you failed to stop at the limit line, depending on the facts of your case, one angle might be to argue that you while you made a complete stop, you were unable to stop right at the limit line because it was faded, obstructed by mud, not visible at night, etc.

  • Raise Doubt that the officer’s observations were accurate.

The best way to do this is to go back to the location of the stop sign and position yourself where the officer was. Take photographs and make a clear diagram showing anything that could have obstructed the officer’s view of you at the stop sign. Think trees, bushes, fences, sign posts, parked cars, etc.

  • Get a Witness to Testify to Your Version of Events

The officer is technically just a witness who will argue that he witnessed you doing something wrong. You are arguing you didn’t do anything wrong, so if you had a passenger with you or know of a bystander who witnessed the event, consult with them to see if they agree to the same version of the event as you, and if they are willing to testify on your behalf to make your version of what happened more credible.

Anyone who has driven in a busy Metropolitan City (take LA) has probably had the experience of getting stuck in an intersection when the light turns red. While you might piss of other drivers who have a green light, up until 1987 it was not illegal to block traffic (just impolite). That is until California enacted the “Anti-Gridlock Act of 1987”.

Here’s what the law says:

  1. (a) Notwithstanding any official traffic control signal indication to proceed, a driver of a vehicle shall not enter an intersection or marked crosswalk unless there is sufficient space on the other side of the intersection or marked crosswalk to accommodate the vehicle driven without obstructing the through passage of vehicles from either side.

You’ll be glad to know a violation of this law is not considered a violation of a law relating to the safe operation of vehicles and is the following:

(1)    A stopping violation when a notice to appear has been issued by a peace officer, or;

(2)    A parking violation when a notice of parking violation is issued by a person, other than a peace officer.

  • Drivers of passenger vehicles are required to wear safety belts properly and to have passengers 16 or older properly restrained by safety belts (CA Veh. Code 27315)
  • Passengers 16 or older are required to wear safety belts in all vehicles and may be cited in addition to the driver (CA Veh. Code 27315)

What to do if You Were Ticketed for an Equipment Violation but No Longer Own the Car

Equipment violations are generally marked as ‘correctable’ on your ticket, meaning if you fix it you are eligible to have it dismissed. Some examples of equipment violations include: illegal tinted windows, missing license plates, worn out tires, or a broken tail light.

Although most equipment violation tickets do not result in a point going on your record, the cost of the ticket will be far less if you have the violation corrected. Upon showing proof of correction to the clerk of the court you will only be charged a nominal fee, generally $25.00. As a comparison, an equipment violation ticket without proof of correction can cost over $100.00. Moreover if you do not have the violation fixed you are at risk for getting subsequent tickets.

Issues arise when you have sold the car since receiving the ticket or the car is now inoperable. If this occurred prior to you having the violation corrected, then you will no longer be able to obtain proof of correction. Therefore you will need to present your case to a judge along with proof of sale (showing you no longer own the car), or the relevant paperwork that shows the vehicle is now inoperable. Many states require drivers who are traveling below the normal speed of the flow of traffic to move to the right (regardless of whether YOU are going the speed limit) and California is one of them.

Everyone in California is required to drive at a speed which is “reasonable and prudent” according to factors such as weather, traffic, and the type of road you are driving on. But apart from this any vehicle driving at a speed less than the normal speed of traffic moving in the same direction shall be driven in the right-hand lane for traffic (or as close as practicable to the right-hand edge or curb). An exception would be if you are overtaking and passing another vehicle.

Many may feel that speeders pose a bigger safety threat than those who drive ‘over cautiously’ however according to a David Solomon (United States Government researcher who wrote a paper in 1964 on the subject of speed and crashes), the crash risk increases at speeds below the average traffic flow versus those above the average traffic flow. Keep At Least One Ear Free While Driving

If you weren’t part of the rush that went out and bought a blue tooth ear piece after the hands free laws went into effect in California, and you aren’t one of those having the luxury of built in blue tooth installed in your vehicle, then maybe you get by with just setting the phone on your lap or wedging it between your seatbelt and chest while using headphones or ear buds so you can still listen and talk while you drive.
