Last year an 18 year old received a ticket for unsafe speed in Orange County. Adams, in his BMW, was nabbed by Irvine PD, using laser, for 70 in a 50. (additional details available newportbar.org/legalarticles)

Adams had a trial, the officer showed up, testified that his speed was unsafe in violation of California Vehicle Code 22350, and Adams was found guilty. Adams appealed. On appeal the conviction was reversed.

The reversal in part was due to the fact the officer did not bring certified copies of the traffic surveys to show that the speed limit of 50 mph on the street Adam’s was pulled over, was justified (the officer’s use of laser or radar on a street with an unjustifiably low speed limit violates speed trap laws). Instead the court took “Judicial Notice” of the surveys as they had copies of the survey available in the courtroom. As it turned out the speed limit of 50 mph was not justified by the traffic survey, the survey only justified a 55 mph speed limit.

Judge Geoffrey Glass held on May 9, 2012, “the trial court’s apparent practice of maintaining the survey in the courtroom and making it available to facilitate the conviction of defendants…who might otherwise obtain favorable judgment under the speed trap laws, create an appearance of partiality and impropriety.” The judge also held that it is the obligation of the prosecution to lay foundation for the admission of a traffic survey.

When you’re caught for speeding the first thing that comes to your mind is where is the officer’s proof? I want to see the proof. This may prompt you to demand to see the officer’s radar gun.

In California (or any other state that we aware of) however, an officer does not have any duty to show you the radar gun. What’s more, he may have a valid reason for choosing to refuse to show you the radar, like a safety concern. He may feel his safety would be compromised by taking you back to the patrol car in the middle of the night, or he may feel your safety would be compromised by walking you back the patrol car where there is high speed traffic on a busy highway.

So if you want to see it, make a polite request, not a demand. If the officer refuses, there is not much you can do, it is not worth getting into an argument and the officer will think you are questioning his authority. Many states require drivers who are traveling below the normal speed of the flow of traffic to move to the right (regardless of whether YOU are going the speed limit) and California is one of them.

Everyone in California is required to drive at a speed which is “reasonable and prudent” according to factors such as weather, traffic, and the type of road you are driving on. But apart from this any vehicle driving at a speed less than the normal speed of traffic moving in the same direction shall be driven in the right-hand lane for traffic (or as close as practicable to the right-hand edge or curb). An exception would be if you are overtaking and passing another vehicle.

Many may feel that speeders pose a bigger safety threat than those who drive ‘over cautiously’ however according to a David Solomon (United States Government researcher who wrote a paper in 1964 on the subject of speed and crashes), the crash risk increases at speeds below the average traffic flow versus those above the average traffic flow. Did you know that if you hold a commercial driver’s license and drive a commercial vehicle at a speed of 15 miles per hour or more above the posted speed limit for trucks with trailers that you can be cited for a misdemeanor? It’s true!

The officer can choose to cite you for the usual violation for speeding in a commercial truck, California Vehicle Code section 22406 (which is an infraction) or he can choose to instead cite you under section 22406.1 (a) of the California Vehicle Code which is a much more serious offense!

You don’t want to wind up paying for a ticket when you didn’t have to in the first place do you? This is a topic we have blogged about in the past but it’s important enough to revisit, because too many people receive notices from police departments or out of state camera company that are meant to fish for information, like your driver’s license number, and to get you to tell on yourself (or someone else) for a red light violation.

Either on the notice itself or an attach page, will be blank lines with fields for you to fill in. If you don’t fill out the back of this notice and send it back to the agency requesting the information from you then they won’t have enough to pin the violation on you and a get a real ticket issued to you through the court. Once you give up this information, the information can be used to get a real ticket filed with the courthouse.

Be very suspicious if you don’t the court house listed on the notice. Be wary if you don’t see a due date.  Be careful if you don’t see a fine amount listed.  You could even go so far as to go on the website for the court in the county the violation supposedly occurred in and do a search for the ticket. You could also try calling the court you think the ticket would have been issued in and inquire if there is any record of a ticket being issued to you, most likely there will not be!

Speed cameras on Ramona Expressway?

While driving on the Ramon Expressway, Highway 371 in Anza, or Highway 60 (between Moreno Valley and Beaumont) you may have seen what looked to be photo radar enforcement and had that sinking feeling that you would be receiving a ticket in the mail.

In reality, a motorist driving a bit too quickly through those areas will see a “slow down” message flash and a white light pulse, which is what, may be confused by some as a camera taking a picture. In reality these are just radar speed feedback signs and no ticket will result.

In fact, the speed cameras (which would allow speeding tickets to be issued by mail much like red light cameras) have not yet been legalized in California and even the recent AB 1311 Bill which sought to legalize speed cameras in California did not make it out of the Assembly by the deadline.

In California we have a basic speed law, that no one can driver at a speed which is unsafe for the surrounding conditions. We also have default speed limits. 25 on residential streets.  Can’t go more than 55 mph on other roads even if no speed limit is posted. And no more than 65 mph on the freeways, unless there’s a posted 70 mph sign.

What if a local government wants to set a speed limit lower than the default 55 mph?  There has to be a survey done in which several factors are looked at to determine the correct speed for that road. Every several years, a city traffic engineer goes out to the street and uses a radar gun to measure the speed of say 100 cars.  The speed of the 15 fastest cars is discarded and the speed of the fastest car remaining is the “85th percentile speed.”  

As the law is currently, if the 85th percentile speed of free flowing traffic on the road is 38 mph, the engineer must round up to 40 mph. A new Assembly Bill (AB 529) if passed would allow the city engineer to, instead of rounding up, to round down.
