Californians may soon get the long awaited question answered: “Is or Isn’t Red Light Camera Evidence Admissible, and if so what are the Rules”.
Two recent court of appeal cases (People v. Borzakian and People v. Goldmith) each decided differently as to the reliability, accuracy, and admissibility of the evidence (namely photographs and video) gathered by red light camera enforcement systems used in court by officers during their testimony. The Supreme Court of California has agreed to first review People v. Goldsmith. The review of Borzakian will be dependent upon the outcome of the Goldsmith review. In any event the Supreme Court Decision will be very important to the area of red light camera tickets.
